1. General Information

These Terms and Conditions govern the use of the website budgetwerk.com and all coaching, consulting and educational budgeting services provided by BudgetWerk, Leopoldstraße 27, 80802 München, Germany ("BudgetWerk", "we", "us"). By accessing this website or engaging our services, you accept these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use our website or services.

These Terms and Conditions are drafted in accordance with German law, including the German Civil Code (BGB) and the EU Directive 2011/83/EU on consumer rights, as implemented in Germany.

2. Scope of These Terms

These Terms and Conditions apply to all contracts, agreements and business relationships between BudgetWerk and its clients, as well as to visitors of the website budgetwerk.com. Any terms and conditions of the client that conflict with or differ from these Terms and Conditions shall not apply unless expressly confirmed by BudgetWerk in writing.

These Terms apply to both consumers (Verbraucher) within the meaning of Section 13 BGB and businesses (Unternehmer) within the meaning of Section 14 BGB. Where specific provisions apply only to consumers or only to businesses, this is stated explicitly.

3. Services Provided by BudgetWerk

BudgetWerk provides educational and coaching services in the field of personal and household budgeting, including but not limited to:

• Monthly budget planning guidance and customised budget frameworks;
• Spending tracking tools, templates and checklists;
• Debt payoff roadmaps based on established methods such as snowball and avalanche strategies;
• Ongoing money coaching, including scheduled check-in sessions;
• Joint budgeting sessions for couples and households;
• Free written and video content published on our website and blog.

All services are of an informational, educational and coaching nature. BudgetWerk does not provide banking, investment, tax, legal or credit brokerage services and is not licensed to do so. Details of the exact scope, duration and format of each paid service are set out in the service description applicable at the time of booking and confirmed in the individual agreement.

4. Conclusion of Contract

The presentation of services on our website does not constitute a legally binding offer but an invitation to submit an offer (invitatio ad offerendum). A contract is concluded as follows:

1. The client submits a request via our contact form, by telephone or by email, or books a consultation directly.
2. BudgetWerk reviews the request and sends a written confirmation, together with these Terms and Conditions and information on the applicable fees.
3. The contract is concluded when BudgetWerk sends the confirmation, or when the client accepts our offer, whichever occurs first.

The contract language is English. BudgetWerk stores the contract text; clients may request a copy of their contract at any time by emailing info@budgetwerk.com.

5. Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal in accordance with Sections 355 ff. BGB. If the contract is concluded remotely (for example, via our website, email or telephone), the consumer may withdraw from the contract within fourteen (14) days without giving reasons. The period begins on the day the contract is concluded.

To exercise the right of withdrawal, the consumer must inform BudgetWerk, Leopoldstraße 27, 80802 München, Germany, email: info@budgetwerk.com, of the decision to withdraw by means of a clear statement (for example, a letter sent by post or an email). The consumer may use a model withdrawal form, which is available on request, but is not obliged to do so.

Consequences of withdrawal: if the contract is withdrawn, BudgetWerk shall reimburse all payments received, including delivery costs where applicable, without undue delay and no later than fourteen days from the day on which notice of withdrawal was received. Reimbursement is made using the same means of payment used in the original transaction, unless otherwise expressly agreed.

If the consumer requests that services begin during the withdrawal period, the consumer shall pay a reasonable proportion of the fees corresponding to the services already provided up to the point of withdrawal compared to the total scope of the contract.

6. Prices and Payment Terms

All prices are quoted in euros (EUR) and include the applicable statutory value-added tax (VAT) unless otherwise stated. Coaching plans are offered on a monthly subscription basis; one-off sessions and workshops may be charged per session or per event.

• Invoices are issued in advance for subscription services and are due within fourteen (14) days of the invoice date.
• Payments are made by the payment methods indicated at checkout or on the invoice.
• If the client is in default of payment, BudgetWerk may charge statutory default interest in accordance with Section 288 BGB.
• BudgetWerk may adjust subscription prices at the end of a billing period with at least four weeks' written notice. Price adjustments for existing subscriptions are limited to reasonable, transparent increases and the client may terminate the subscription with effect from the next billing date if the adjustment is not accepted.

The right to set off counterclaims is excluded unless the counterclaim is undisputed or has been established by a final court decision. The client may only exercise a right of retention if it relates to claims arising from the same contractual relationship.

7. Client Obligations

To enable BudgetWerk to deliver effective coaching, the client agrees to:

• provide accurate and complete information about their financial situation to the extent they choose to share it;
• attend scheduled coaching sessions on time or cancel at least 24 hours in advance; late cancellations or missed appointments may be charged in full;
• use all materials, templates and tools provided solely for personal purposes;
• not share login credentials, if applicable, with third parties.

BudgetWerk does not require access to the client's bank accounts, financial statements or payment credentials at any time. Clients should never disclose online banking passwords, PINs or full payment card numbers to BudgetWerk or anyone claiming to represent BudgetWerk.

8. No Financial Advice Disclaimer

BudgetWerk's services are educational and coaching services. They do not constitute individual financial, investment, tax or legal advice within the meaning of the German Securities Institutions Act (WpIG), the Legal Services Act (RDG) or tax advisory regulations (StBerG). BudgetWerk is not a licensed financial institution, insurance broker, tax advisor or law firm.

All budgeting methods, projections and recommendations are based on the information provided by the client and general best practices. Results depend on individual circumstances, consistency and market conditions outside BudgetWerk's control. BudgetWerk makes no guarantee of specific financial outcomes, savings amounts or debt reduction timelines. Past results of other clients are not indicative of future results. Clients remain solely responsible for their own financial decisions.

9. Intellectual Property

All content on budgetwerk.com — including texts, graphics, logos, budgeting templates, spreadsheets, checklists, videos and the BudgetWerk name and logo — is the property of BudgetWerk or its licensors and is protected by German and international copyright and trademark law.

Clients receive a simple, non-transferable, non-exclusive right to use the materials provided for their own personal purposes. Any reproduction, distribution, public display, modification or commercial use of the materials without the prior written consent of BudgetWerk is prohibited. Brief quotations with clear source attribution are permitted for non-commercial purposes.

10. Data Protection

BudgetWerk processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details on the collection, processing and use of personal data, the legal bases, retention periods and the rights of data subjects are set out in our Privacy Policy.

BudgetWerk acts as the data controller for data collected via this website and within coaching engagements. Data subject requests (access, rectification, erasure, restriction, portability and objection under Articles 15–21 GDPR) can be sent at any time to info@budgetwerk.com. In addition to the website cookies described in our Cookies Policy, BudgetWerk uses only the technical cookies that are strictly necessary for the operation of the website; all other cookie categories are set only with prior consent, which may be withdrawn at any time with effect for the future.

11. Limitation of Liability

BudgetWerk shall be liable without limitation for damage caused by intent or gross negligence, for damage resulting from injury to life, body or health, and in cases of liability under the German Product Liability Act (ProdHaftG).

In the event of slight negligence, BudgetWerk is liable only for breach of material contractual obligations (Kardinalpflichten) and only up to the amount of damage typical and foreseeable at the time of contract conclusion, in any case no more than the fees paid by the client in the twelve months preceding the damaging event. Liability for slight negligence is otherwise excluded. These limitations do not apply to consumers where mandatory statutory provisions provide otherwise.

BudgetWerk does not guarantee the uninterrupted availability of the website. Temporary downtime for maintenance or technical reasons does not give rise to any claims.

12. Contract Term and Termination

Subscription-based coaching plans run for the agreed minimum term and renew automatically for successive periods of the same length unless terminated with a notice period of fourteen (14) days to the end of the respective billing period. Either party may terminate for good cause (wichtiger Grund) without notice, provided that the terminating party notifies the reason in writing after being asked, or sets a reasonable deadline where the reason lies in a breach of duty.

One-off sessions and workshops end upon completion of the agreed service. Statutory extraordinary termination rights remain unaffected.

13. Changes to These Terms

BudgetWerk may amend these Terms and Conditions where this is necessary due to legal, regulatory or technical changes or changes in market conditions, provided the amendments are reasonable for the client. Amendments will be communicated in writing or by email at least four weeks before they take effect. The client's continued use of the website or services after the effective date constitutes acceptance; clients may object to the amendments within the notice period, in which case the contractual relationship ends at the next permissible termination date.

14. Governing Law and Jurisdiction

These Terms and Conditions and all contracts concluded under them are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the consumer's country of habitual residence is not withdrawn.

The exclusive place of jurisdiction for all disputes with businesses is Munich, Germany. For consumers, the statutory place of jurisdiction applies. The European Commission provides an Online Dispute Resolution platform, which is available to consumers; BudgetWerk is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
